apostilė būtina?
Kad JAV ar
kitose šalyse išduoti dokumentai (išskyrus pasus) ar jų kopijos būtų
pripažįstami Lietuvoje (tame tarpe Generaliniame konsulate), jie turi būti
patvirtini apostile (angl. Apostille).
Kaip atrodo
apostilė?
Tai prie
tvirtinamo dokumento ar notaro patvirtintos dokumento kopijos prisegtas
standartinio dydžio lapas su antspaudu.
Ar būtina
apostile tvirtintus dokumentus versti į lietuvių kalbą?
Taip- ne
lietuvių kalba išduoti dokumentai turi būti verčiami į lietuvių kalbą. Jeigu
JAV apostile tvirtintas dokumentas bus vežamas tiesiai į Lietuvą, vertimą
galima atlikti Lietuvoje ir patvirtini pas vietinį notarą. Jeigu dokumentas
su apostile bus teikiamas Generaliniam konsulatui, vertimo tvirtint
notariškai ir apostile nereikia.
Kokie
dokumentai tvirtinami apostile?
Apostile
dažniausiai tvirtinami civilinės metrikacijos faktus liudijantys dokumentai-
gimimo, santuokos, mirties liudijimai ir t.t. ir jų oficialūs dublikatai.
Kas dar
tvirtinama apostile?
Apostile dar
tvirtinamos JAV notaro patvirtintos dokumentų kopijos. Pvz.: vairuotojo
pažymėjimo, nuolatinio gyventojo kortelės, teismo sprendimo ir t.t. Tokiu
atveju apostilė paliudys tik kopiją tvirtinusio notaro parašo tikrumą.
Apostile dar galima tvirtini JAV notaro parašo tikrumą kuomet notaras
dokumente (pvz.: pareiškime, paaiškinime, įgaliojime) patvirtina piliečio
parašo tikrumą.
Kokia JAV
institucija tvirtina apostile?
Kiekvienoje
valstijoje išduotus dokumentus apostile tvirtina tos valstijos "Secretary of
State Office". Taip pat notaro parašą tvirtins tik notaro valstijos valdžia.
Turiu Las
Vegase išduotą santuokos liudijimą. Kaip patvirtinti šį dokumentą
apostile? Šiuo metu gyvenu Niujorko valstijoje ir ketinu konsulate
apskaityti santuoką.
JAV kiekviena
valstija turi šiek tiek skirtingą tvirtinimo apostile procedūrą. Jums
reikėtų susisiekti su Nevados valstijos Secretary of State Office" ir
pasitikslinti kaip tai galima atlikti paštu. Greičiausiai teks paštu gauti
santuokos liudijimo dublikatą ir jį vėl paštu siųsti į Nevadą tvirtinimui
apostile.

valstija, kaip ir kelios kitos, naudoja 2 pakopų procedūrą. Jei gimimo
liudijimas išduotas seniai, greičiausiai teks gauti naują dublikatą, su juo
vykti į County Clerks Office patvirtinimui ir tik po to į Secretary of
State Office" apostilei gauti.

Turėtumėte
kreiptis į notarą, kad jis patvirtintų kortelės kopiją ir po to tą kopiją
tvirtinti apostile (kai kuriose valstijose notaro parašas bus tvirtinamas County
Clerks Office ir tik po to dokumentas bus nešamas apostilei gauti).

jeigu notaras atsisako tvirtinti dokumento kopiją?

valstijų notarai atsisako tvirtinti kai kurių dokumento kopijas. Tokiu
atveju jums reikėtų kopijoje parašyti, kad tvirtinate kopijos tikrumą, o
notaras patvirtins jūsų parašą.
Ar Lietuvoje
išduoti dokumentai turi būti tvirtinami apostile ir kokia institucija teikia
šias paslaugas?
Teoriškai- taip, tačiau praktika rodo, kad JAV dažniausiai apostilės
neprireikia. Lietuvoje išduotus dokumentus apostile tvirtina tik
Užsienio reikalų ministerija.
Gyvenu Oregono valstijoje ir neturiu galimybių
atvykti į Generalinį konsulatą. Norėčiau mamai į Lietuvą parašyti įgaliojimą
parduoti butą. Ar galiu parašyti įgaliojimo tekstą, pas vietinį notarą
patvirtinti savo parašą ir notaro parašą apostile? Ar toks įgaliojimas
galios Lietuvoje?
Galite, tačiau lietuvių kalbos nesuprantantis notaras
turėtų atsisakyti tvirtinti parašą po nesuprantamu tekstu. Neradus lietuvių
kalbą suprantančio notaro, reikėtų parašą tvirtinti po anglišku tekstu, o
mama Lietuvoje tekstą išverstų ir notarizuotų.
Dėl tokio įgaliojimo galiojimo gali kilti keblumų, nes
pagal kontinentinę teisę (JAV-bendrosios teisės valstybė), notaras,
priklausomai nuo pasirašyto dokumento turinio, atlieka skirtingus veiksmus.
Pavyzdžiui konsulas ar Lietuvos notaras, tvirtindamas įgaliojimą (vienašalę
sutartį), tvirtina ne tik asmens parašą, bet ir dokumento turinį bei formą.
Žinomą, JAV notaras neturi nei galimybių, nei patirties tokiems veiksmas
atlikti. Dėl to rekomenduotumėme konkrečiu atveju pasitarti su Lietuvos
institucija, kurioje įgaliojimas bus naudojamas.
